Digital Design & File Use Disclosure
To purchase digital CNC and laser files from Deans Guitars, you must first create and be logged into a member account. This lets you access your past orders and re-download your files at any time.
Before completing payment, you are required to read this Digital Design & File Use Disclosure. At checkout, you will confirm that you agree to these terms for any digital files you purchase.
DIGITAL PRODUCT AND INTELLECTUAL PROPERTY DISCLOSURE
1. DESCRIPTION OF DIGITAL ASSETS: Deans Guitars (hereinafter "the Company") provides specialized digital assets including, but not limited to, CNC toolpaths, laser-ready design files, SVG vectors, blueprints, and technical project schematics. All transactions constitute the acquisition of a usage license rather than the transfer of legal title or ownership of the underlying digital code or design.
2. SCOPE OF LICENSING AGREEMENT: Upon verification of payment, the Company hereby grants a limited, non-exclusive, and non-transferable license to the specific purchasing entity for the following purposes:
2.1. Local utilization and storage of digital assets for fabrication via CNC or laser hardware.
2.2. Modification of asset parameters to align with unique production equipment workflows.
2.3. The manufacture and commercial sale of physical goods derived from the digital assets, provided that the individual product listing does not expressly prohibit such manufacture.
3. PROHIBITED USES AND RESTRICTIONS: The Licensee is strictly prohibited from engaging in the following activities:
3.1. Re-distribution, sub-licensing, or resale of the original or modified digital files in any electronic format.
3.2. Publicly hosting or uploading assets to third-party marketplaces, cloud services, or community forums.
3.3. Representing the designs as the Licensee’s original intellectual property.
3.4. Utilizing the assets to create derivative digital design products intended for commercial competition.
4. INTELLECTUAL PROPERTY RIGHTS: All designs, metadata, and technical instructions remain the exclusive and perpetual intellectual property of Deans Guitars. This agreement conveys only the right to use the designs under the stipulations herein, and all unenumerated rights are reserved by the Company.
5. CUSTOM DESIGN PROVISIONS: Projects developed from client-provided sketches or proprietary concepts may be subject to supplemental Custom Design Agreements. In the absence of such specific documentation, current standard licensing terms apply only to the execution of the file rather than the initial client concept.
6. NON-REFUNDABLE NATURE OF DIGITAL GOODS: Due to the intangible nature and immediate delivery of digital assets, all acquisitions are final and non-reversible. The Company maintains a strict no-refund policy, notwithstanding applicable statutory consumer rights. Technical support is available for any defects encountered during the file extraction or utilization process.
7. FORMAL BINDING ACKNOWLEDGMENT: By maintaining a registered account and executing a transaction, the User formally acknowledges having reviewed, understood, and consented to be legally bound by this Disclosure. Confirmation at the point of checkout serves as a digital signature of agreement to all stipulated terms.
